Enforcement of Ohio No Smoking Ban Now in Effect

The enforcement of Ohio’s indoor smoking ban took effect on May 3, 2007. For information about compliance, please refer to the Ohio Department of Health’s website at http://www.odh.state.oh.us/.

Beginning May 3, alleged violations will be reported to local health departments, which are responsible for investigating the violation within their jurisdiction. According to the Ohio Department of Health, a business’ first violation will result in a warning letter, the second violation will receive a $100 fine, the third a $500 fine, the fourth a $1,500 fine, and any subsequent violations after the fourth fine will result in a $2,500 fee. Individuals that violate the smoking ban will receive a warning letter on their first violation and $100 fine for their second violation and every subsequent violation.

As part of the ban, any “place of employment” or “public place” must post “No Smoking” signs that contain the phone number for reporting violations (866) 559-OHIO.
