Mandated Paid Sick Leave Proposal

The Mandated Paid Sick Leave Proposal is a citizen-lead proposal to change Ohio law. It will likely appear on the November 2008 ballot as the Healthy Families Act for a vote of the people.

The proposal would mandate:

  • Employers with 25 or more employees provide 7 paid sick days to full-time employees annually and a pro-rated amount of sick leave for part-time employees annually.
  • Employee flexibility in using the time. It could be used in various increments, depending how the employer tracks time.
  • Employees do not have to show medical documentation until three consecutive days of leave are used.
  • Full time employees are those who work more than 30 hours per week and part-time employees are those who work less than 30 hours per week or less than 1,560 hours per year.

In addition the proposal includes employer directives on record keeping, posting requirements, enforcement, current leave policies and prohibited acts.

The proposal is in the final stage of the process to get on the November 2008 ballot. The citizens supporting the proposal need to collect and submit 120,000 valid signatures by August 2008 to the Ohio Secretary of State.
